Australia Visas for investment and business

This Business Innovation and Investment (Provisional) visa (subclass 188) has replaced the majority of other Australian visas for investment and business in 2012. The visa is divided into four streams that each cater to a distinct class of investor or businessperson and may be used to obtain legal permanent residence within Australia with the Business Innovation and Investment (Permanent) visa (subclass 888). The applicants can typically seek legal residency within 12 months of being in Australia. Candidates for this visa need to provide an Expression of Interest using the Skillselect system prior to being invited submit an application.

All applicants must not have been involved in unacceptably or illegal investment or business actions.

Streams

There are four streams available for this Business Innovation and Investment (Provisional) visa (subclass 188) Each stream has specific eligibility requirements. Check out the following pages for more information about the visa streams that are available:

  • Business Innovation track is for business professionals who are looking to establish or grow an existing business in Australia
  • investor stream is for investors who wish to invest at minimum AUD$1.5 million Australia and keep business or investment activities with Australia for at minimum 2 years
  • significant investor stream For investors who wish to put down at minimum AUD$5 million Australia and maintain business or investment activities in Australia beyond the time of their temporary visa
  • Premium investor stream is for investors who wish to make a minimum investment of AUD$15,000,000 in an Australian “compliant premium institution” and carry on investment or business activities in Australia following the expiration of their temporary visa

Australian Business Innovation Stream Subclass 188 Visa

The business innovation stream caters designed for business professionals who are successful and want to create or expand an enterprise in Australia.

Conditions for eligibility

Candidates who are seeking those seeking the Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream must meet a variety of eligibility requirements in order for their visa to be granted. The applicant must:

  • A nominating request of the Australian State or Territory government
  • Ownership of a different business for at minimum 2 of the prior four financial years. The business must have had a total annual revenue of at minimum AUD$500,000 those years.
  • The owner in one or more of these:
    • Minimum 51% of a company that has the annual sales that is lessthan AUD$400,000.
    • Minimum 30% of the business with an annual revenue that is more than AUD$400,000.
    • Minimum 10% ownership in an publicly traded company
  • A total of AUD$800,000.00 worth of personal and/or business assets that must be legally acquired and capable of being moved to Australia within two years from the date that the visa was granted. The assets of your spouse or partner are counted towards this amount.

If the company nominated to fulfill the requirements above offers services of a technical, professional, or trade nature, then you should have spent at least 50 percent of your time delivering these services on your own and at least 50 percent of your time in managing the company.

Candidates must be typically at least 55 years old to be eligible for this visa, however the age requirement may be removed at the discretion of the state or territory that nominates them in the event that the proposed venture will contribute to the state’s or territory’s economy in a significant way.

Australian Investor Stream Subclass 188 Visa

The investor stream intended for investors looking to invest at minimum AUD$1.5 million Australia and keep their business or investing in Australia for a minimum of 2 years.

Conditions of eligibility

Candidates to apply for visas under the Business Innovation and Investment (Provisional) visa (subclass 188) Investor stream applicants must meet certain eligibility requirements in order before they can be issued a visa. The applicant and/or their companion (if relevant) must meet:

  • A nominating request of the Australian federal or state government
  • At at least 10 percent ownership and management of a business that is deemed to be a qualifying one for at least one financial year within the last 5 year financials, OR
    • Investments that are eligible must be at least AUD$1.5 million
  • A high level of managerial ability in relation to the qualifying company or the investment that is eligible, and at least three years of direct experience in management
  • An amount of AUD$2.25 million in business or personal assets that must be legally acquired and can transfer to Australia within 2 years from the date that the visa was granted. Your spouse or you must have held these assets for a minimum of 2 financial years.
  • The intention to reside with that nominating Australian area or state for at the very least two years

The applicant must be or less to be eligible for this visa, however the age requirement may be removed at the discretion of the state or territory nominating the applicant in the event that the investment proposed will enhance the state’s or territory’s economy in significant ways.

Australian Significant Investor Stream Subclass 188 Visa

It is the Australian Significant Investor stream 188 visa is designed for investors looking to invest at minimum AUD$5 million within Australia and maintain business or investment activities in Australia beyond the duration of their visa provisional.

Eligibility requirements

Candidates to apply for those seeking the Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor stream must meet a number of qualifications to have their visa granted. The applicant, and/or their companion (if relevant) must meet the following requirements:

  • Get a nomination from an Australian government in a state or territory as well as from the Australian Trade Commission (Austrade)
  • At least 5 million AUD in investment funds. They must be legally acquired and be able for investment in Australia
  • Confirm that it will not bring any action legal against Australia in connection with any loss relating to the investment.

The applicants must also be able to live at least Australia in Australia for a minimum of 40 days each year during the term for the duration of their visa. Another alternative is for the spouse of the applicant to reside in Australia for 180 days each year during the term that the visa is valid. The applicant must be a resident of the territory or state that they were nominated (if there is one).

Conditions for investment

Significant Investor applicants have to make an investment that is at least AUD$5 million over a period of 4 years. This amount of the investment is required to be done in the following manner:

  • A minimum of AUD$500,000 for growth and venture capital equity funds, which invest in small and start-up private firms.
  • Minimum AUD$1.5 million of approved managed funds to invest in companies that are emerging and that are listed in the Australian Stock Exchange
  • Minimum of $AUD3 million for ‘balancing investments managed funds can invest in a variety of assets, including listed companies on the ASX, Australian corporate bonds or annuities, notes, and commercial real property.

Investment in direct residential real estate is not permitted and indirect investment via the funds managed above is severely restricted.

Premium Investor stream (Subclass 188)

This stream of Premium Investor is designed for investors looking to invest at minimum $15 million in an Australian “compliant premium institution” as well as continue investment or business activities in Australia following the expiration of their visa provisional.

Conditions for eligibility

The applicants to apply for those seeking the Business Innovation and Investment (Provisional) visa (subclass 188) Premium Investor stream must satisfy a variety of conditions for eligibility for approval. The applicant, and/or their companion (if relevant) must meet the following requirements:

  • Request a nomination from Australia Trade Commission (Austrade). Australian Trade Commission (Austrade)
  • Minimum of 15 million AUD in investment funds. They must be legally acquired and be able for investment in Australia
  • Confirm that it will not bring an action in court against Australia for any loss related to the investment.

Conditions for investment

Candidates for the Premium Investor stream must be prepared to invest minimum AUD$15 million. The money must be invested in one of the following ways:

  • Australian securities exchange-listed assets
  • Australian bond, semi-government, or government notes or bonds
  • Notes or corporate bonds that are issued by an Australian exchange-listed company (or an entirely owned subsidiary or affiliate of an Australian exchange listed company) as well as investment grade rating Australian corporate notes or bonds that are rated by an AFS licensed credit rating agency
  • Australian Limited liability companies that are owned by proprietary
  • Property in Australia with residential properties excluded
  • Annuities deferred issued by Australian Life companies that are registered with the Australian government.
  • Governments of the State or Territories have authorized philanthropic contributions

Entrepreneurship Innovation as well as Investment (Provisional) (subclass 188) visa (subclass number 188) points system

Candidates who are applying for applicants for Business Innovation and Investment (Provisional) visa (subclass 188) business Innovation stream and the the Investor stream must score at minimum 65 points in the following tables in order to be qualified to apply for the visa. Candidates for the Significant Investor stream and Premium Investor stream Important Investor stream as well as the premium investor streams are not required to pass testing for points.

The citizens of UK as well as The US, Canada, New Zealand as well as New Zealand, Canada and the Republic of Ireland automatically score 10 points in the English language. Others applicants can choose to pass one or more of tests listed below:

Ownership interest in a gazelle business

  • The principal business that is named must be registered no more than five years ago.
  • The average growth in turnover for the principal company must have been greater than 20% over the course of three consecutive financial years.
  • In the 3 years preceding that time, the company must have more than 10 employees during one financial year or more.

Recipient of grants or venture capital funds

  • It is required that you have an amount of at least $10,000 by the government in your country within the past 4 year OR
  • It is required that you have had venture capital investment funds that are at least AUD$10,000 within the past 4 years.
  • The funds must be received in the beginning phases of the company with the intention of setting up growth, development, expansion and/or commercialisation of the product.
